This is a courtesy translation of our German-language privacy policy for your convenience. The German version is legally binding. Swiss data protection law (FADP) applies, and, where applicable, the GDPR.

We will indicate if, in individual cases, there are other data controllers responsible for the processing of personal data. Personal data refers to any information relating to an identified or identifiable individual. A data subject is a person in respect of whom personal data is processed. Processing encompasses any handling of personal data, regardless of the means and methods used, in particular the retention, disclosure, collection, gathering, erasure, storage, alteration, destruction and use of personal data.

We use our own consent tool to manage the cookies and similar technologies (tracking pixels, web beacons, etc.) employed and the relevant consents. You can adjust your privacy settings at any time via the cookie banner at the bottom of the screen.

The legal bases for the processing of personal data in this context are Article 6(1)(c) of the GDPR and Article 6(1)(f) of the GDPR. Our legitimate interest is the management of the cookies and similar technologies used, and the associated consents.

The provision of personal data is neither contractually required nor necessary for the conclusion of a contract. You are not obliged to provide personal data. If you do not provide personal data, we will be unable to manage your consents.

We process the personal data necessary to provide our services on a permanent, user-friendly, secure and reliable basis, to communicate with you and your employer, to conclude contracts and to process orders. The data may be used for marketing and PR purposes, as well as for market and customer analysis and business management; in individual cases, it may also be used for legal proceedings, investigations and to combat fraud. We also process publicly available business-related personal data, or data provided by GDPR-compliant providers, for marketing purposes. The processing of this personal data is based on our legitimate interest (in accordance with Article 6(1)(f) of the GDPR) in providing these individuals with relevant information and offers regarding our products and services. In doing so, we have carefully weighed up the interests, fundamental rights and freedoms of these individuals and have concluded that our interest in improving and optimising our products and services, as well as in effective marketing strategies, outweighs their interests, given the nature of the data we process and the benefits you can derive from our offers. You have the right to object to this processing at any time, and we will no longer process these individuals’ data for these purposes if an objection is raised, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of these individuals.

Such personal data may fall into the categories of customer and contact details, browser and device data, content data, meta or ancillary data and usage data, location data, sales, contractual and payment data. Other possible categories include credit reports, references, documents relating to you, recommendations and information from third parties, your social media/online activities and publications in which you appear, extracts from government registers and information from legal proceedings.

We process personal data for as long as is necessary for the respective purpose or purposes, or as required by law. Personal data that is no longer required for processing is anonymised or deleted. Individuals whose data we process generally have the right to erasure.

We generally process personal data only where such processing is permitted on legal grounds, for example to fulfil a contract with the data subject and for corresponding pre-contractual measures, to safeguard our overriding legitimate interests, because the processing is apparent from the circumstances, or following prior notification.

Within this framework, we process, in particular, information that a data subject voluntarily and of their own accord provides to us when making contact – for example, by post, email, contact form, social media or telephone – or when registering for a user account. We may store such information, for example, in an address book or using similar tools. If you provide us with personal data relating to third parties, you are obliged to ensure data protection in relation to such third parties and to guarantee the accuracy of such personal data.

We also process personal data that we receive from third parties, obtain from publicly available sources or collect whilst providing our services, provided that such processing is permitted for legal reasons.

Definitions and legal bases

We process personal data relating to job applicants to the extent that it is necessary for assessing their suitability for employment or for the subsequent performance of an employment contract. The personal data required is derived in particular from the information requested, for example in the context of a job advertisement. We also process personal data that applicants voluntarily provide or publish, in particular as part of cover letters, CVs and other application documents, as well as online profiles.

Nature, scope and purpose

We may have personal data processed by commissioned third parties, or process it jointly with third parties or with the assistance of third parties, or transfer it to third parties. Such third parties include, in particular, providers whose services we use, service providers who process your data partly on our behalf (e.g. IT providers) and partly on their own responsibility – e.g. insurance companies, authorities in Switzerland and, where applicable, abroad, business partners, project partners and others. We also ensure an appropriate level of data protection with regard to such third parties. Such third parties are generally located in Switzerland and within the European Economic Area (EEA).

However, such third parties may also be located in other countries and territories, provided that, in the opinion of the Federal Data Protection and Information Commissioner (FDPIC), or if adequate data protection is ensured for other reasons, such as through a relevant contractual agreement – in particular on the basis of standard contractual clauses – or through relevant certification. In exceptional cases, such a third party may be located in a country without adequate data protection, provided that the requirements under data protection law – such as the explicit consent of the data subject – are met.

Job applications

Data subjects whose personal data we process have the rights set out in Swiss data protection law. These include the right of access and the right to rectification, erasure or restriction of the processing of personal data.

Data subjects whose personal data we process have the right to lodge a complaint with a competent supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

Processing of personal data by third parties, including abroad

We take appropriate and suitable technical and organisational measures to ensure data protection and, in particular, data security. However, despite such measures, the processing of personal data on the internet may always be subject to security vulnerabilities. We cannot therefore guarantee absolute data security.

Access to our online service is provided via transport encryption (SSL/TLS, in particular using the Hypertext Transfer Protocol Secure, abbreviated to HTTPS). Most browsers indicate transport encryption with a padlock icon in the address bar.

Access to our online services is subject – as is the case with all internet use – to mass surveillance without cause or suspicion, as well as other forms of surveillance by security authorities in Switzerland, the European Union (EU), the United States of America (USA) and other countries. We have no direct influence over the processing of personal data by intelligence services, police forces and other security authorities.

Data security

We maintain a presence on social media platforms and other online platforms in order to communicate with interested parties and provide information about our services. In doing so, personal data may also be processed outside Switzerland and the European Economic Area (EEA).

The General Terms and Conditions (GTC) and Terms of Use, as well as privacy policies and other provisions of the individual operators of such online platforms, also apply in each case. These provisions provide information, in particular, on the rights of data subjects, which include, in particular, the right of access.

In particular, we use:

Facebook (social plugins): embedding of Facebook functions and Facebook content; providers: Meta Platforms Ireland Limited (Ireland) and other Meta companies (including those in the USA); information on data protection: Privacy Policy.

Instagram platform: Embedding of Instagram content; providers: Meta Platforms Ireland Limited (Ireland) and other Meta companies (including in the USA); data protection information: Privacy Policy (Instagram), Privacy Policy (Facebook).

LinkedIn Consumer Solutions Platform: Embedding of LinkedIn features and content; Provider: Microsoft; LinkedIn-specific information: ‘Privacy’, Privacy Policy, Cookie Policy, Cookie Management / Opting out of email and SMS communications from LinkedIn, Opting out of interest-based advertising.

Social media

We may collect the following information each time you access our website, provided that this information is transmitted by your browser to our server infrastructure or can be determined by our web server: date and time, including time zone; Internet Protocol (IP) address; access status (HTTP status code); operating system, including user interface and version; browser, including language and version; individual sub-pages of our website accessed, including the amount of data transferred; the last webpage accessed in the same browser window (referrer).

We store such information, which may also constitute personal data, in server log files. This information is necessary to ensure that our online service is available on a permanent, user-friendly and reliable basis, and to guarantee data security and, in particular, the protection of personal data – including through third parties or with the assistance of third parties.

Tracking pixels

We may use tracking pixels on our website. Tracking pixels are also known as web beacons. Tracking pixels – including those from third parties whose services we use – are small, usually invisible images that are automatically retrieved when you visit our website. Tracking pixels can be used to collect the same information as in server log files.

Server log files

Performance and reach measurement — Google Analytics

We use Google Analytics to analyse how our website is used, which also enables us, for example, to measure our website’s reach and the effectiveness of third-party links on our website. This is a service provided by the US-based company Google LLC. For users in the European Economic Area (EEA) and Switzerland, Google Ireland Limited is responsible.

Google also attempts to track individual visitors to our website when they use different browsers or devices (cross-device tracking). Cookies are also used for this purpose. Google Analytics requires your Internet Protocol (IP) address, but this is not combined with other data held by Google.

In all cases, we ensure that your Internet Protocol (IP) address is anonymised before it is analysed by Google. As a result, your full IP address is generally not transferred to Google in the USA.

Google Tag Manager

We use Google Tag Manager to integrate and manage analytics and advertising services from Google and third parties on our website. This is a service provided by the US-based company Google LLC. For users in the European Economic Area (EEA) and Switzerland, Google Ireland Limited is the data controller. No cookies are used in this process, although cookies may be used in connection with the services integrated and managed via this tool. We provide information on the processing of personal data by such services in this privacy policy.

Third-party services

We use third-party services to ensure that our website is available at all times and is user-friendly, secure and reliable. Such services also enable us to embed content on our website. Such services – for example, hosting and storage services, video services and payment services – require your Internet Protocol (IP) address, as they would otherwise be unable to transmit the relevant content. Such services may be located outside Switzerland and the European Economic Area (EEA), provided that an adequate level of data protection is guaranteed.

For their own security-related, statistical and technical purposes, third parties whose services we use may also process data relating to our website and from other sources – including cookies and log files – in an aggregated, anonymised or pseudonymised form.

Digital infrastructure

We use third-party services to access the digital infrastructure required for our website. These include, for example, hosting and storage services from specialist providers.

Audio and video conferencing

We use audio and video conferencing services to communicate with our customers and other individuals. In addition to this Privacy Policy, any terms and conditions of the services used shall also apply.

Vimeo: Video platform; provider: Vimeo Inc. (USA); information on data protection: Privacy Policy.
YouTube: Video platform; provider: Google; YouTube-specific information: ‘Privacy and Security Centre’.

Maps

We use Google Maps to embed maps on our website. Cookies are also used for this purpose. Google Maps is a service provided by the US-based Google LLC. For users in the European Economic Area (EEA) and Switzerland, Google Ireland Limited is responsible.

Google Ads

We use Google Ads (formerly AdWords) to advertise our services in a targeted manner on the Google search engine and elsewhere on the internet, for example on other websites, based, amongst other things, on search queries. Google Ads is a service provided by the US-based company Google LLC. For users in the European Economic Area (EEA) and Switzerland, the Irish company Google Ireland Limited is responsible. Cookies are also used in connection with Google Ads.

Our aim with such advertising is, in particular, to reach people who are interested in our online services or who already use them. To this end, we transmit relevant information – which may include personal data – to Google (remarketing). We can also determine whether our advertising is successful, i.e. whether it leads to visits to our website (conversion tracking).

LinkedIn

Our online service uses features of the LinkedIn network. The provider is LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. Every time you access one of our pages that contains LinkedIn features, a connection is established with LinkedIn’s servers. LinkedIn is informed that you have visited our website using your IP address. Please note that, as the provider of the website, we have no knowledge of the content of the data transmitted or how it is used by LinkedIn.

Free Instant Analysis (SEO Analysis Tool)

On our website, we offer a free instant analysis of your website, implemented technically through our software partner SE Ranking (SE Ranking Ltd., headquartered in Riga, Latvia).

Purpose: If you request an analysis, we process the URL you provide as well as your email address. This is used to deliver your analysis results and to allow us to follow up with you once, within three days, in case you may need support in the area analysed.

Data Processing & Location: We have concluded a data processing agreement with SE Ranking. SE Ranking is headquartered in Riga, Latvia, and therefore within the European Union (EU). SE Ranking's privacy policy can be found here: seranking.com/legal/privacy-statement.html.

Retention & Deletion: Your data is used exclusively for this purpose and is not stored permanently. If you do not respond, or if there is no interest in further cooperation, the data will be deleted. Your data will not be added to any newsletter list without separate consent.

Objection: You may object to being contacted at any time, informally, e.g. by email to kontakt@zuendstoff-marketing.ch.

Website extension

We use Akismet to distinguish legitimate comments made by humans from unwanted comments made by bots and other spam. Cookies are also used for this purpose. Akismet is a service provided by Aut O’Mattic A8C Ireland Ltd. in Ireland and by the US-based Automattic Inc., which is known, amongst other things, for its WordPress.com service.

Final provisions

We may amend and supplement this privacy policy at any time. We will provide information about such amendments and supplements in an appropriate manner, in particular by publishing the current version of the privacy policy on our website.
